Municipal Ordinances and Merger – State v. Stafford

Late yesterday, the Appellate Division released State v. Stafford. This case involves the concept of merger of similar ordinance violations upon conviction. The Court authorizes using the Code of Criminal Justice standards for merger of ordinance violations. There is also an excellent review of other important issues ranging from federal pre-emption to proof based upon circumstantial evidence.
